The Ministry of Electronics and Information Technology (MeitY) of India recently issued a new circular regarding market surveillance of products under the mandatory BIS registration.

The Software Technology Parks of India (STPI) has been designated to carry out market surveillance activities. The costs associated with the surveillance are to be borne by the factory or certificate holder. Samples will be randomly purchased from the market and tested in BIS-recognized laboratories, as directed by STPI. Notifications regarding the surveillance order will be sent via email to the registered factory, their authorized Indian representative, and the designated testing laboratories. Registered factories must fully cooperate with the surveillance process, which includes updating contact information, promptly providing required information and documentation, and paying the related fees.

Since the circular was announced, some factories have already received market surveillance orders. To better prepare for market surveillance, we have summarized the following key points for your reference:

First, the products regulated by this order mainly include electronics and information technology products, such as IT equipment, audiovisual devices, small household appliances, batteries, and lighting products. The products selected for surveillance will be drawn from the registered products of the factory, and only products with a valid R-number during the surveillance period will be subject to inspection.

Second, regarding the BIS marking requirements. Both the product and its packaging should display the BIS mark. If the product is too small to place this mark, it is acceptable to place the mark only on the packaging. (The above image shows the BIS mark).

Finally, ensure the validity of the certification for critical components of the product. To ensure consumer safety, critical components used in the product (such as batteries) should be certified, and manufacturers must use certified components to produce their products.

If the certification for certain critical components is canceled, the product manufacturer shall change the venders and use registered components in production.

If the final product was manufactured before the component registration was canceled, the certification of the product will not be revoked. However, manufacturers will be required to take corrective actions to ensure the product's safety.
